Terms of Service

These terms are the agreement between you and Cuff (“Cuff”, “we”, “us”) whenever you browse this site or order a band from it. Please read section 8 closely — it explains the one circumstance in which we refund an order.

Accepting these terms

By placing an order, creating an account, or otherwise using this site, you agree to these Terms of Service and to our Privacy Policy. If you do not agree with them, please do not order from us.

If you are ordering on behalf of a company or another organisation, you confirm that you are authorised to bind that organisation to these terms.

Who may order

You must be at least 18 years old, or the age of majority where you live, to buy from us. By ordering, you confirm that the billing and delivery details you give us are accurate and that you are authorised to use the payment method you provide.

We ship to the destinations listed at checkout. We may decline or cancel orders to any territory we are unable to serve lawfully.

What we sell

Cuff sells replacement bands for fitness trackers. A band is the only item in your order: no tracker, charger, or other hardware is included, and none of our products contain electronics.

Product photography is representative. Colour reproduction varies between screens, and small variations in texture, weave and finish are normal for the materials we use. Those variations are not defects.

Compatibility and trademarks

Our bands are designed as third-party accessories to fit certain Fitbit and Whoop devices. Cuff is an independent brand. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Fitbit, Google, or Whoop, and those names are the trademarks of their respective owners, used here only to describe which devices our bands fit.

Compatibility is stated in good faith for the device models listed on the product page. It is your responsibility to check that the model you own is one of them before ordering. Fitting a third-party band may affect your device manufacturer's warranty; that is a matter between you and them.

Orders and acceptance

Adding an item to your cart does not reserve stock, and an order confirmation email is an acknowledgement that we received your order — not our acceptance of it. The contract between us is formed only when we dispatch the goods.

We may refuse or cancel an order before dispatch if the item is out of stock, if a price or description was published in error, if we suspect fraud or resale, or if we cannot complete delivery to the address given. Where we cancel an order you have already paid for, we refund that payment in full.

Pricing, promotions and payment

Prices are shown in the currency displayed at checkout and may change at any time before you order. Unless stated otherwise, prices exclude delivery charges, and exclude any import duty or tax charged when a parcel enters your country — those are your responsibility as the importer of record.

Buy two, get one free

Where our “buy 2, get 1 free” offer is running, every third band in a single order is supplied free of charge, and colours may be mixed. The free band has no cash value, cannot be exchanged for a discount or credit, and cannot be combined with other offers unless we say so. If you return a paid band from a qualifying order, we may adjust the refund to reflect the value of the free band you keep. We may withdraw or change any promotion at any time; the terms shown at the moment you order are the ones that apply to that order.

Payment

Payment is taken through our payment processor at checkout. We never see or store your full card number. If a payment is reversed or charged back after dispatch, we may recover the goods or the amount owed.

Shipping and delivery

We aim to dispatch orders within 2 business days. Delivery estimates shown at checkout are estimates, not guarantees, and we are not liable for delays caused by carriers, customs, weather, or events outside our reasonable control.

Risk in the goods passes to you on delivery to the address you gave us. If your parcel is recorded as delivered but you cannot find it, contact us within 14 days and we will open an enquiry with the carrier.

Returns and refunds

The rule in short

We only accept refunds if the product arrives damaged. Orders that arrive in sound condition are not refundable, and we do not accept change-of-mind returns.

What counts as damaged

A band is damaged if it reaches you torn, split, cut, mis-stitched, missing part of its fastening, or otherwise unusable as a band. Normal variation in colour, weave and texture, a band that fits a device you did not tell us about, and wear that appears after use are not damage.

How to claim

  1. Email support@wearcuff.com within 14 days of delivery, quoting your order number.
  2. Attach clear photographs of the damage and of the packaging it arrived in. We need these to raise the fault with our manufacturer or carrier, so a claim without them cannot be assessed.
  3. Keep the band and its packaging until we have finished assessing the claim. We may ask you to return the item, in which case we pay the return postage.

If we accept the claim, you choose a free replacement or a full refund of what you paid for that item, including its share of any delivery charge. Refunds go back to the original payment method within 10 business days of approval. A free promotional band that arrives damaged is replaced rather than refunded, since no money was paid for it.

What is not refundable

  • Change of mind, or a band that simply was not to your taste.
  • Ordering the wrong colour, size or device fitting.
  • Damage caused after delivery, including wear, staining, alteration, or misuse.
  • Bands presented for refund after the claim window above has closed.

Your statutory rights

Nothing in this section removes or limits any right you have under the consumer law of the country you buy from. Some jurisdictions — including the UK and the EU — give consumers a separate right to cancel a distance purchase within a set period regardless of the condition the goods arrive in. Where such a right applies to you, it applies in addition to the policy above, and this section does not override it.

Warranties and disclaimers

We warrant that the goods we send will match their description and be free from manufacturing defects at the point of delivery. Beyond that, and to the fullest extent the law allows, the site and the goods are provided “as is” and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Our bands are accessories, not medical or safety equipment. Nothing we sell measures, monitors, diagnoses, or treats any condition, and the accuracy of any tracker you attach one to is a matter for that device's manufacturer.

Acceptable use of the site

You agree not to:

  • scrape, crawl, or harvest content or data from the site by automated means;
  • interfere with the site's operation, security, or availability, or attempt to gain access to systems or accounts that are not yours;
  • place fraudulent, speculative, or automated bulk orders; or
  • resell our products commercially without our written agreement.

We may suspend or block access where we reasonably believe any of the above is happening.

Intellectual property

The Cuff name, wordmark, site design, photography, and copy are owned by us or our licensors and are protected by intellectual property law. You may not copy, reproduce, or reuse them without our written permission, except for the ordinary personal use of viewing this site.

If you send us reviews, photographs, or other material, you keep ownership of it and grant us a non-exclusive, worldwide, royalty-free licence to use it to market and operate our business.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, loss of profit, loss of data, or damage to any device an accessory is fitted to.

Nothing here limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the site, or your infringement of anyone else's rights.

Changes and suspension

We may update these terms as our business changes. The version in force when you place an order is the version that governs it, so the “last updated” date above matters. We may also change, suspend, or discontinue any part of the site or product range without notice.

Governing law and disputes

These terms are governed by the laws of the country in which Cuff is established, whose courts have jurisdiction over any dispute, except that consumers keep the right to bring proceedings in the courts of their own country of residence where local law gives them that right.
